GUEST WAIVER & RELEASE

⚠️ WAIVER & RELEASE OF LIABILITY -- THIS AGREEMENT CONTAINS A WAIVER & RELEASE OF LIABILITY AND INDEMNITY AGREEMENT TO WHICH YOU WILL BE BOUND, AND UNDER WHICH YOU WILL BE WAIVING IMPORTANT LEGAL RIGHTS. ⚠️ DO NOT SIGN THIS AGREEMENT BEFORE YOU READ IT. ⚠️

This agreement is entered into between Process Driven Sports Academy, hereinafter referred to as "the Facility", and the legal adult, along with any minor children that may accompany the adult onto the premise located at 600 E Moeller Street, Suite #5, Prescott, Arizona 86301, hereinafter referred collectively to as "the Guest."

FACILITY RULES AND REGULATIONS: The Guest agrees to adhere to all facility rules and safety regulations as provided at the time of entering The Facility and as updated from time to time. This includes safety protocols, equipment use, and behavioral standards.

⚠️ LIABILITY, RISK, AND SAFETY ACKNOWLEDGMENT: The Guest understands that by entering The Facility—whether as a participant, spectator, or guest—they may be in proximity to athletic activities that involve inherent risks of injury. This includes, but is not limited to, the possibility of contact with baseballs, softballs, bats, weights, or other sports equipment.

Assumption of Risk: By entering The Facility, the Guest and any accompanying guests voluntarily assume all risks of injury or property damage that may result from athletic or fitness activities, even if they are not participating directly. This includes observing from areas near batting cages, pitching tunnels, or training spaces.

Spectator & Viewing Area Safety:

• Baseballs and softballs may leave designated hitting or pitching areas unexpectedly.

• Anyone who chooses to observe from outside designated viewing or waiting areas does so at their own risk.

• ⚠️ Do not sit, stand, or bring chairs directly next to active cages or tunnels.

• Always remain alert and supervise minors closely.

• Children must stay in designated viewing or waiting areas and may not be near active training zones unless participating in a scheduled session.

🥊Boxing Participation & Certification Requirement: The Facility provides boxing equipment and training opportunities for members, clients and guests. Use of boxing bags, gloves, mitts, or fitness-based boxing drills is covered under The Facility’s general liability policy when performed safely and under standard supervision.

However, any contact boxing activity, including sparring or partner drills that involve striking another person, is permitted only under the supervision of a USA Boxing–certified coach and by participants who hold active USA Boxing certification.

• Non-contact boxing (such as bag work or fitness drills) may be performed by members with a signed Facility waiver.

• Contact boxing (sparring or glove-to-body activities) requires:

  • Active USA Boxing athlete membership, and

  • Direct supervision by a USA Boxing–certified coach.

• The Facility’s general liability insurance does not cover injuries sustained during unsanctioned sparring or contact training.

• Proof of active USA Boxing certification must be provided before participating in any contact boxing activity.

General Safety:

• The Facility may post additional safety rules throughout the premises. All members and guests are required to read and follow these at all times.

• Failure to follow staff instructions or posted rules may result in immediate removal from The Facility without refund.

🎦 Surveillance Notice: For safety, security, and quality assurance, The Facility maintains continuous video surveillance in training and common areas. Recordings may be reviewed to confirm incidents, enforce safety policies, or evaluate facility improvements.

✅ Release of Liability: The Member, on behalf of themselves, their guests, and any minors under their care, releases and holds harmless Process Driven Sports Academy, its owners, trainers, employees, and affiliates from any and all liability, claims, or causes of action arising out of injury, accident, or property loss occurring in or around The Facility, including spectator areas, parking lots, and adjacent spaces.

⚠️ My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. 

FACILITY SAFETY PROTOCOLS 

I, as the Guest, agree to follow the guidlines listed below at all times, along with any minor children that accompany me onto the premise. If I bring children that are not participating in training activies into the facility, I agree to supervise the children AT ALL TIMES and ensure they all follow the saftey guidleines. 

• Children 12 and under must be accompanied and directly supervised by an adult (18+) unless:
  • The child is attending a scheduled individual or group training session with a professional coach or certified trainer, currently contracted with Process Driven Sports Academy. 
  • The child is attending a team practice and the coach of that team is present.
• All children under 14 years old must be signed in by an adult at the front desk AND the assigned professional coach or certified personal trainer MUST be present.
• No children under the age of 7 will be allowed in or near the batting cages area.
• Any adult or child entering The Facility MUST have a waiver on file AND have signed in at the front the desk.
• No children or adults are allowed to enter the batting cages, pitching tunnels, utlize the equiptment (weights, boxing, cardio) without a current membership AND reservation - NO EXCEPTIONS

Batting/Pitching Cage Rules

• You must be at least 14 years of age to use a batting cage or pitching tunnel without direct adult supervision - no exceptions. 
• 2 persons MAX: No more than 2 people are allowed in a batting cage or pitching tunnel at a time unless that client is directly supervised by a PDSA Team Member.
• ⚠️ When using a pitching machine - Everyone involved MUST wear a helmet, including the "feeder". No exceptions
• ⚠️ No person is allowed behind the batting cages for any reason.
• WATCH for people walking in front of the cage or near the netting of your cage.
• DO NOT load a pitching machine while another person is behind the batter.
• ENSURE the batter is ready to receive a pitch BEFORE throwing or loading machine. 

We are so happy to have you at the facility!

Whether you are a new, potential client or an existing client, each person, for their own safety will need to read and agree to the waiver above. We have many services offered in our facility and we want to ensure the safety and security of every client. 

➡️ When filling out the form below, ensure you list every minor child that could potentially come into the facility that lives within your household. All legal adults, will have to fill out a seperate waiver for themselves.

✅ This will ensure each person will be able to enter quickly without extra time spent at the front desk. 

No person is allowed in the facility without a waiver on file.
